GoodMood Community Guidelines (“Community Guidelines”) govern your use of GoodMood’s Platform (“Platform”) and are incorporated into GoodMood’s Terms of Service (“Terms of Service”). Please note that the Terms of Service will prevail in case of any conflict between the Community Guidelines and the Terms of Service. All capitalized terms used in the Community Guidelines are already defined in the Terms of Service. Strict action may be taken against you or your Account, including immediate termination of your account, by GoodMood in case of any violation of the Community Guidelines .

1. Follow the Law, GoodMood’s Terms of Service, GoodMood’s Privacy Policy, Third Party’s Terms of Service and The Community Guidelines

You hereby understand and agree that under any circumstances:

• You will not be using the Platform, intentionally or unintentionally, in or in a way that promotes, the violation or breach of any applicable law or regulation.
• You will not put GoodMood, intentionally or unintentionally, in or in a way that promotes, the violation or breach of any applicable law or regulation.
• You will not be engaging in any act that GoodMood deems to be in conflict with the spirit or intent of the Platform. It includes, without limitation, not engaging in manipulation or circumvention of the Terms of Service, the Community Guidelines , other Miscellaneous Terms, or any other GoodMood policies.

You hereby understand and agree that:

• In case you use any third-party platform provider such as Apple, Bing etc. (each a “Third party”) for accessing and/or using the GoodMood Platform you will be required to abide by all the terms of service of such Third party, including any the payment terms that may apply when you make a payment through the Third Party. In case of any conflict between the Community Guidelines and the applicable Third Party’s terms, the applicable Third Party’s terms will prevail.

2. Account Creation and Use

Your GoodMood Account creation and use will be governed by the following Community Guidelines :

• At any given time, you cannot have more than one Account, per Third party; you cannot create an Account on behalf of someone other than yourself or create an Account using false information or identity credentials.
• Without GoodMood’s written consent or permission, you shall not rent, sell, trade, gift, bequeath, lease, sublicense, or otherwise transfer your Account or any Virtual Items associated with your Account to anyone. GoodMood will consider such transfer or attempted transfer is prohibited and void.
• Without GoodMood’s written consent or permission, you shall not use or access an Account or Virtual Items that may have been rented, sold, traded, gifted, bequeathed, leased, sublicensed, or otherwise transferred from the creator of the original Account.

3. Improper Use of Others’ Personal Information

You hereby understand and agree that under any circumstances:

• You will not try to unlawfully access Accounts or try to unlawfully obtain login information which belongs to another user.
• You will not try to obtain, misuse, or disseminate content or non-public personal or sensitive information of another user.
• You will not, without GoodMood’s express written consent or permission, try to upload or transmit, or attempt to upload or transmit, any material that acts as a active or passive information transmission or collection mechanism, such as but not limited to gifs, pixels, web bugs, cookies, or other similar devices or technologies (sometimes referred to as “spyware,” “passive collection mechanisms” or “pcms,” or “malware”).

4. Offensive or Infringing Content

You hereby understand and agree that:

• You shall not be posting any content or a link to content that is libelous, obscene, threatening, defamatory or abusive;
• You shall not be posting any content or a link to content that is sexually, racially, religiously, or otherwise offensive or objectionable;
• You shall not be posting any content or a link that is promotes or incites violence; or violates any applicable law or regulation;
• You shall not be posting any content or a link to content that contains nudity, excessive violence, or offensive subject matter;
• You shall not be posting any content or a link to content that is infringing or violating someone else’s intellectual property or other proprietary rights
• You shall not be posting any content or a link to content that is disclosing or aiding in the disclosure of someone else’s confidential information.
• You shall not be posting any content or a link to content that contains malicious content, such as but not limited to malware, spyware or viruses;
• You shall not harass, abuse, or harm, or advocate or incite harassment, abuse, or harm of another person or group, including without limitation GoodMood’s employees and customer service representatives.
• You shall not impersonate another person, including without limitation a GoodMood employee.

5. Commercial Activity

You hereby agree and understand that:

• You will not be using the Platform for any unauthorized commercial purpose, including but not limited to (1) communicating a commercial advertisement or facilitating a commercial transaction, including without limitation spamming other players; (2) offering or soliciting Accounts or Virtual Items for sale or transfer; or (3) soliciting donations or contributions to any personal or charitable cause.
• You will not be using the Platform for performing in-game services, such as but not limited to item-collection services, in exchange for payment outside the Platform.

6. Unauthorized Use of or Connection to the Platform

You hereby agree and understand that:

• You will not design, use, distribute, or sell any automation software, bots, or any unauthorized third-party or other software designed to modify or interfere with the Platform or any GoodMood game experience.
• You will not institute, execute, assist, encourage, or become involved in any type of attack on the Platform, including without limitation distribution of malware, making a denial-of-service attack, or any other attempt to disrupt the Platform or any other person’s use or enjoyment of the Platform.
• You will not try to gain unauthorized access to the Platform, Accounts registered to others, or to any computer or server used to offer or support the Platform or any GoodMood game environment or network connected to the Platform by any means other than the user interface provided by GoodMood, including without limitation by circumventing or modifying or causing to be modified, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, file, or software that is part of the Platform.
• You will not use, facilitate, create, or maintain any unauthorized connection to the Platform, including without limitation (1) any connection to any unauthorized server that emulates, or attempts to emulate any part of the Platform; or (2) any connection using programs, tools, or software not expressly approved by GoodMood.
• You will not use any unauthorized third-party or other software that accesses, intercepts, “mines,” or otherwise collects information from or through the Platform or that is in transit from or to the Platform, including without limitation any software that reads areas of RAM or streams of network traffic used by the Platform to store information about GoodMood game characters, elements, or environments. GoodMood may, at its sole and absolute discretion, allow the use of certain third-party user interfaces.
• You will not intercept, examine, or otherwise observe any proprietary communications protocol used by a client, a server, or the Platform, whether through the use of a network analyzer, packet sniffer, or any other tools.
• You will make any automated use of the Platform or take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure.
• You will not bypass any robot exclusion headers or other measures we employ to restrict access to the Platform or use any software, technology, or device to send content or messages, scrape, spider, or crawl the Platform, or harvest or manipulate data.
• You will not interfere or try to interfere with the proper functioning of the Platform, or connect to or use the Platform in any way not expressly permitted by the Terms of Service, Feature Terms, or these Community Guidelines , including without limitation disrupting, overburdening, or assisting in the disruption or overburdening of the Platform.
• You will not make improper use of GoodMood’s customer support services, including by submitting false abuse reports or using profane or abusive language in communications with our support personnel.
• You will not except where permitted by law or relevant open source licenses, modify, reverse engineer, decompile, disassemble, decipher, or otherwise try to derive the source code from us, or to obtain any information from the Platform using any method not expressly permitted by GoodMood.
• You will not copy, modify, or distribute content from any GoodMood game, site, or Service or content protected by GoodMood’s copyrights, trademarks, or other intellectual property rights, or use any method to copy or distribute any content in the Platform except with GoodMood’s written permission.
